Regulation 28

South African pension funds are governed by Regulation 28 of the Pension Funds Act. Under the regulation, a fund has a fiduciary duty to act in the best interest of its members whose benefit depends on the responsible management of fund assets. This duty entails a responsible investment approach that will earn adequate risk-adjusted returns suitable for the fund’s specific member profile, liquidity needs and liabilities.

Pension funds subject to Regulation 28 must comply with investment limits set out in the regulation. They must have a formal investment policy in place, and take a responsible investment approach that will earn adequate risk-adjusted returns. Each fund needs to show that it is ensuring that its assets are appropriate to its liabilities and that it understands the nature of the assets in which it invests. Finally, funds are required to use the ‘look-through’ principle where an asset holds underlying assets.

Regulation 28 imposes a significant data management requirement on affected pension funds. Those covered by the regulation are responsible for collecting data, monitoring and identifying breaches, all of which need to be reported to fund representatives. Finally, data must be collated at different fund levels, such as asset manager and total fund level, and then compiled into prescribed certificates for submission to the regulator.
